Post by xjessyx » Mon Mar 16, 2015 6:07 pm

Can anyone please explain the difference between interim care order and special guardian. In a bit confused with it all at the moment a court date has been planned for the 27th an social services want to place my nephew with me they said this will be done with an interim care order an long turn with special guardian. Thanx

Hi
There is a section on this site with advice sheets which have lots of detail. Someone better than me at computer stuff might put a link in a reply to you.
There are lots of differences, but the main one is who has parental responsibility and can make decisions for the child. With a care order, interim or full, the local authority share parental responsibility with the child's parent(s). Under special guardianship the special guardian has overriding parental responsibility. The local authority have none.
There are all sorts of issues to think about. Don't let the social worker tell you that you have to have a special guardianship order. There are alternatives including kinship fostering which may be better depending on the circumstances.
Good luck. x

All the advice sheets will be found at http://www.frg.org.uk/need-help-or-advice/advice-sheets.

With the ICO the child effectively is in the care system and is then placed with you with the LA retaining the control. This should then be a fostering situation.

With the SGO, you have the control (PR), technically shared with the parents, but with the right to exercise it to the exclusion of others.

Best wishes ..... Robin
