Ex husband on sex offender's register

Hi. My ex-husband has recently been convicted of possessing child pornography and placed upon the sex offender's register . Historically we had joint residency of the children but since the allegations came to light they were temporarily placed in my full care. Now the criminal court case is over, he is bow pushing to get residency back even though he is on the sex offenders register for another 4 1/2 years.

Has anyone come across this situation before.

Also i am totally confused by the sex offenders register as it appears he can still take the kids under supervision to a skate park at weekends which means he is mingling with other kids.

Dear Riomelas,

Welcome to the parents’ forum and thank you for your post. I am sorry to hear about the difficulties that you have been experiencing.

You don’t say if children’s services have become involved. If they are involved then it would be a good idea to discuss with the social worker what their recommendations are regarding contact between your children and their father. Although children’s services have no legal jurisdiction regarding contact in this situation they can make recommendations. If they were concerned that the children were at risk of significant harm in their father’s care then they would expect you to ensure that the children were safeguarded (for example by stopping contact or ensuring contact was supervised). Ultimately it is vital that you only agree to a level of contact that you feel is safe for your children. You might find it helpful to look at our website here for information about children’s services involvement when there is a concern about sexual abuse.

If the children’s father is unhappy with the level of contact you suggest then he can make an application to the family court. This would be a private law process. For more advice regarding this you can contact Rights of Women, Child Law Advice and Support Through Court.

Childrens services were involved when the police investigation was first started. At which point, the children were temporarily placed in my full time care by the court. A safe contact agreement was drawn up with the help of children's services and he has had supervised contact with the children ever since. Childrens Services chose to close their file prior to the ctiminal case being concluded as they were satisfied that i had kept my children safe. I have raised the matter with childrens services since his crimal convictions were filed and they were not interested in reviewing the case in terms of the guidelines for contact. There has been absolutely no help from childrens services whatsoever or even the probation office in terms of what safe contact should look like moving forward,now he has been placed on the sex offenders register. I am completely shooting in the dark as there is no guidance out there for this kind of situation.

Thank you for your further post.

You say that children’s services ended their involvement after a safe contact agreement was drawn up. They felt that you were able to keep your children safe and have told you that they are not going to get back involved now that the criminal case has concluded.
Ultimately it is down to you to ensure that you feel confident that your children are safe when they are with their father. You may decide to alter the contact arrangements as time goes on, depending on the wishes of your children, their ages and your confidence in terms of their safety. I am not able to offer any advice as to the specifics of this, however Acts Fast may be able to offer some specific advice and support regarding this. You may also find it helpful to contact the Stop It Now helpline or access their online forums.

As I previously advised if the children’s father is unhappy with the level of contact you are willing to allow then he can make an application to the family court. This would then be considered by the court and a Child Arrangements Order may be made specifying who the children live with and what contact they should have with the other parent.
