Hi, bit of a strange one but here goes, Bare with to see how it's relvelant.
Basically takibg my friend to court as she has owed me over 6k for over 3 years. As her defence claim she has character assainated me, in order to make me look like a bad person and lying. I have proof on how lich is still owed so not a problem
However, I had a breakdown in 2018, and she is using this about my character, but has also mentioned children services in ir, and something not major but that wasn't the case. First of all I don't think it's relevant to use my children in a monetary case but also she is a manager at that children's services. There is no detail, but is this a breech or not, should I ignore or say something.
It's really upset me as I don't know why my children at been used in this, there was no further action and they live with me.
Thanks in advance, just wonder what other people think.

From the information you have given I would not be happy that she has mentioned your children. As a person in that line of work surely she has breached gdpr by mentioning this in a court statement which is nothing to do with your children. I would be inclined to raise a complaint with the office she works in asking if this is acceptable or is infact a breach of gdpr.

Thankyou, she has also mentioned something that was in the original report children services reporrn but I had to have it removed, as it claimed I had a fraud conviction which. I most certainly don't. This is also in her defence, however, whether this is from hear say or the report I am unsure.
She has put no proof to why she feels she doesn't owe me the money, just about my children and false convictions

Dear Feelingconfused2006
Welcome to the Parents’ Forum and thank you for your post. My name is Suzie and I am Family Rights Group’s online adviser.
You are involved in a court case where you are suing another person for a debt. We cannot advise on this aspect.
However, you are concerned that this person, who is a children’s services’ manager, has made reference to information about your historic involvement with children’s services and to a report which contained incorrect information which you had removed. You are understandably worried that your and your children’s confidential data may have been breached in this way and that there is a conflict of interest as your current court case is a money claim and not a family court matter. This has caused you distress.
In view of your concerns, here are some options for you to consider. You could:
Contact the Information Commissioner to get advice and to see whether you may take steps under data protection legislation. Their helpline number is 0303 123 1113.
Make a formal complaint to Children’s Services about your concern that your confidential information has been shared by this person in their personal capacity. Please see how to make a complaint here.
Discuss your concern with a solicitor. You can find a specialist solicitor via the Law Society find a solicitor website.
If the person is a registered social worker you can contact Social Work England about your concerns. However, they recommend you raise issues with the social worker’s employer first.
I hope this is helpful to you.
Best wishes
Suzie
