Non molestation order against me on false allegations now section 37 being done in regards to my son?? please HELP?!!

Post by dmp150290 » Sun Mar 21, 2021 1:39 pm

Hi i am currently in a very negative place mentally and am struggling to get to visit my son, He is in the care of my biological mum and my sons father who also now lives with my biological. i was struggling with home schooling and because of this i agreed for my son to stay there while the home schooling was a struggle and so that he could have time with his father but then i got my son a place in school under vulnerable child covid19 because i felt that my biological mother had alliterative motives. i tried to get my son home and both my biological mum and my sons father refused. This has now got to the point police, social services are involved. And i have had a non molestation order granted on a emergency basis without findings or evidence. and the judge has now granted a section 37 report to be done in regards to my son which i am pleased at because my concerns for my sons long term well being haven't been took into consideration till now. what i need to know is can i now get legal aid in relation to the section 37 so i can get legal representation as i was only allowed legal help before? and also how can i push for the right to see my son in person when he and my biological mother are saying he doesn't want to and the social worker has said its up to him. I know this isn't my sons true wishes and more the wishes have been put on to him. please help its killing me not seeing my boy and i want the best for him and for him to be safe.

Dear dmp150290

Thank you for your post and welcome to the Board.

I am sorry to read about your situation. From what you write you are in a private law case and need legal help and or advice, this is not our specialist area therefore I would like to signpost you to Child Law Advice and this page from Advice Now. It may be useful to check if you are eligible for legal aid.

We have an advice sheet about Child Arrangements Orders, it is written for carers but is helpful to parents too.

I hope this information is useful.

Best wishes

Suzie
