Advice on changing children surname if dad is flagged up under sarah law

hi

I'm wanting to know if a childs father who has had no contact for 3 years, has now been registered under sarah law, would this help in changing the children's surnames without the father's consent, as he wouldn't give it?

Dear superstar01

Welcome to the parents’ discussion forum and thanks for posting.

In your post you have said that your child has had no contact with the father for 3 years and because of the father’s history you wish to change the child’s surname.

As the father is named on the child’s birth certificate this means he has parental responsibility. Before a child’s surname can be changed you would need to make an application to the court for an order to allow you to do so.

This would be a private law case and, as such, you can seek advice from Child Law Advice on 0300 330 5480 about the process.
