sgo allowance

Post by Cellbar » Sat Aug 13, 2011 4:07 pm

Is this allowance still means tested? We are due for renewal and I just wondered if there had been sny changes or cases that may have a bearing on our argument for continuation of its payment.

Hi,

Yes SGO allowance is still means tested. However the LA, when deciding the amount of allowance to pay, should have regard to the amount of foster care allowance that would be paid if the child was fostered. This was upheld in the case of R(B) v Lewisham LBC (2008) EWHC 738. Please have a look at our SGO advice sheet if you want more information about this.

Best wishes

Suzie
