Cognitive Impairment Accusations
SW and CS Team, are still trying to push for the angle of cognitive impairment, to imply I have some sort of mental health issues. I do not have a history or any medical history of mental health issues or any cognitive impairment. Why are they pushing this? Are they trying to push this, so they can apply to the court and attach documentation to a CLL0A form, to imply I have Mental Health issues to a judge to justify why they are not returning my kids to me?

I am sorry to hear that you feel children's services are misrepresenting you and that you do not understand why they are concerned about your mental health.
Have you spoken to the social worker and asked them to explain why they think this is the case? What evidence are they using to back this up?
Have you undergone a psychiatric or psychological assessment?

I have undergone my Psychological Assessment and the report makes it very clear that I do not have any impairment and no history of any impairment.
I do not want to publish the reason the LA gave as it it would identify me, but the reason given was something that was complete nonsense. They were very aware that I did not have any history of any impairment, so it is very concerning they attempted to push this narrative.

This information will support the court to make their decision. As advised previously it would be a good idea to go back to children’s services to understand their position better.

Would you believe the LA are still pushing this angle, despite no evidence. I find it a real concern that the LA cannot accept expert reports and cannot accept there is no evidence and no historical evidence of any Cognitive issues, what do they want a MRI scan of my brain to see if it is there or damaged!
I am currently pending on further documentation that will dispute the claims the LA have made.

hi i went through court 2 years ago but im hearing new things about the cognetive assessment that a low iq is an automatic fail on the assessment and having it used against me what can i do about it as i don't think its right for sw to do that to a parents who can speak there mind perfectly

If you research cognitive tests for these types of assessments, it is similar to those used for assessing dementia patients. It is very basic stuff, like reading, identifying shapes etc. If you can read write and add up, then there should not be any problems passing this type of test. If you do not have or never been diagnosed with any impairment, then the LA should not be making accusations.

Welcome to the parents’ discussion board and thank you for your post. My name is Suzie and I am Family Rights Group’s online adviser. I am sorry that I was not able to reply to your post sooner.
You are worried that you were unfairly treated ago because of the cognitive assessment you had when you were in court a couple of years ago. A cognitive assessment looks at how a person’s brain processes thoughts and information based on a range of questions and tests, as another parent has described. The assessment also looks at how a person functions and behaves. It would be used to make recommendations to court.
It is difficult for me to give you specific advice as the information is so limited and we do not know what happened in court. I also don’t have the expertise to explain about cognitive assessments in any great detail. However the solicitor you had at the time of the court case should be able to clarify what assessment you had, its outcome and how this affected your case. They may have considered challenging the outcome of the assessment in court? If you can, try to see if they can help explain what happened in your case or on what basis decisions were made. Or if you have a copy of the transcript of the judgment you may be able to see why and how the judge made their decision.
Did you have an advocate at the time or now who can help you with your query? Social workers and the courts should follow good practice guidance when working with parents who have a learning difficulty or disability and should make sure they have an independent advocate to support them . And any parenting assessments should be specialist PAMS assessments.
