Revoke placement order

Postby twilight1107 » Sun Jul 16, 2017 10:27 am

Any one know what the next stage is?

I put in application for permission and the main application to revoke and paid fee. What happens next? If they grant permission does it look like good news or will there be an evidence hearing?

Dear Twilight1107

Thank you for your further post.

I see that you have now made an application to the court seeking permission to apply to revoke the placement order.
When an application for permission to apply to revoke placement is made, the court applies a two stage process as follows:
• Firstly to decide whether there has a change of circumstances which is enough to justify reopening the case
• If so, then to exercise its discretion to decide if leave to apply should be granted
You can see what needs to be considered before a decision will be made. The process is covered by s24 of the Adoption and Children Act 2002

In response to your question as to whether permission means its good news or an evidence hearing. Permission being granted means that the judge making the decision thinks the change in circumstances is enough to reopen the case so it could be said to be good news as the court will look further at the case.

The court is therefore likely to look at the evidence available regarding the change of circumstances being relied on. It might be helpful for you to seek legal advice if permission is granted.

You may be able to obtain advice from Coram Children’s Legal Centre 0300 330 5480. Please not that they do not offer advice if you are outside England or already have a solicitor.

I hope you find this helpful.

Best wishes

Suzie

Hi, Thank you.

The court only listed this for 15 mins, and L A put in their place court order to place children, I think our revoke application is going to be thrown out.
