Hi,
It depends, is there a fact finding hearing? The Gaurdian will say in her final report what she thinks should happen, sometimes they agree with L A sometimes they don't. Depends on your case realy.

Dear Whitelight,

At the final hearing of care proceedings, the court will be deciding where your children will be living permanently. As twilight says, it will depend on the facts of your case.

So the court could order that:

• The children return home to mum or dad.

• The children are to live with friends or family. This could be under a care order, or private law order such as a special guardianship order.

• A supervision order, initially up to 12 months, is sometimes ordered. This is to allow children services to monitor and provide support to children who return back to their parents or who go to friends or family carers, such as grandparents.

• the court could order that the children are to stay in local authority care-such as foster care or residential unit. The court would grant a full care order in these circumstances.

The court may well also make orders around who the children will be having contact with.

• If none of the above is appropriate, and only as a last resort, if nothing else will do, then the court can give the local authority permission to place the children for adoption. This is called a placement order.

Look at pages 33 onwards of our advice sheet about care proceedings .This sets out the different court orders and what they mean.

What are your family circumstances? I might be able to provide more specific advice.
