Father on bail for child sexual abuse

Hi everyone, I wonder if someone can give me advice or something. To cut story short, my son's father been on bail for child sexual abuse and he took me to court for contact. Could I tell judge I don't want any court proceedings until he's been cleared of allegations? Thank you.

Welcome to the parents’ discussion forum and thank you for your post.

My name is Suzie, online adviser at Family Rights Group. You appear to have concerns about contact between your son and his father due to investigations of him regarding child sex abuse.

It is not clear from your post whether you have any children’s services (new name for social services) involvement with your family. In your post you mention that your son’s father is on bail for child sex abuse and I wonder whether your local children’s services have been informed as they could offer advice about contact.

You say that your son’s father has taken you to court for contact. If you are not agreeable to contact taking place whilst the police is investigating the matter of child sex abuse, there is no reason why you are unable to say to the judge that you would like contact to wait until the police investigations are completed. It will then be for the judge to make a decision based on the evidence before the court in the private law proceedings.

If you do not have a solicitor representing you in the court case, you could seek advice from Coram Children’s Legal Centre (Child Law Advice) on 0300 330 5480. This organisation advises on private law matters. Our service advises when children’s services are involved in what are described as public law matters.

You may also wish to contact the Lucy Faithfull Foundation on 0808 100 0900 as this organisation can offer advice and support where sex abuse is an issue.

I never had dealings with social services until my child's father been accused of allegations. We had social services coming to do assessment, all she reminded me was to safeguard my kids. And because our son is 2 I think he is vulnerable, because if something happens while with father, he won't be able to tell me. And besides all these allegations, there's more (his mental health etc)
I just wasn't sure if I could ask judge to stop court proceedings while investigation is going. Thank you for your reply
