Thanks Justiceright and Murray for your valuable comments. As I already asked above, will be helpful if I could go to court and get my SOPO varied exempting any prohibitions on my contact with my children to be borne ? Thanks ever so much

But his human rights were being infringed because that was being used as a factor to prevent him having a family.
He said his case was important nationwide as his searches on the internet revealed "thousands of couples are having their children taken away" without fair and open procedures being followed, contrary to the human rights.
The woman told the judge: "I want to keep my baby and help (the man) raise his daughter."
The hearing continues.

In your most recent post you ask how you can find out the decision of a case in the High Court.

Finding a decision will depend on whether the judgement is published and if it is you will be able to find it in law reports for the tier of court that made the decision. If you were to put something about court decisions relating sex offenders in a search engine this might give you details of any such cases.

I asked the Social Worker for the assessment report. She replied it could take up to 40 days or even more. She said she had been phoning the Police for their report but was not getting through. My wife's delivery is due in the first week of Nov 2015, but delivery might well happen in October. What happens if by then if they have not been able to get all the assessments done including the Psychologist assessment? I understand they cannot remove the baby without a court decision unless they see me an immediate danger to the baby. . Being on sex offender register is not a predictor that I will offend again. I had only one child abuse, or otherwise, offence 17 years ago. I should be able to come off the register by April 2015. If their assessment is not complete by the time the baby is born, can they see me as immediate danger and take the baby away?

When the above link downloaded, you will notice the 3 High Court Judges decision declaring prohibition on sex offenders with their own or their own children or family's children (brother, nephew) infringe the Human Rights of children to access to their family.
I would be grateful. however, if you could please advise me
a) The above decision is not too old to be applicable now
b) Will it help me if I send the above link to the Social Worker dealing with my case

Thank you for your further post. I am pleased that you were able to find the information you wanted regarding the court’s decision in the case you mentioned in your earlier post.

In response to your recent queries:

a) I think the decision was one made by the Court of Appeal. A decision can be referred to in any case to highlight a particular point if the circumstances are the same or similar in nature. The date of a decision is not usually an issue. However, it a higher court e.g. Supreme Court made a different decision about the same matter it could overturn or change the impact the earlier decision.

b) The social worker dealing with your case is more concerned about the safety and wellbeing on the child. If you have a solicitor I suggest that you discuss this case with him/her and you can then be advised as to whether this decision will assist you.

You are not in court proceedings at the moment with Children Services and it is normally in arguments before the court that cases can be used to support someone’s position. Having said that, you could, of course, mention to the social worker that there is a court decision about people in a similar situation to you. The social worker might ask their legal department about your situation taking account of the Court of Appeal's decision.

It would be Children Services’ legal department who would be consider how it affects your particular situation and give advice.

Quickly to remind you, I am pasting down a copy of my SOPO

04 April 2014: Extract from my new varied Order
Terms of variation:*****must not have any contact with any female child under the age of 16 years other than: such as inadvertent and not reasonably avoided in the course of lawful daily life or where the child is accompanied at all times by a person aged 18 years or more which has not been convicted of a sexual offence, an offence of decency or any offence against a child and with the consent of the child’s parent or guardian who has full knowledge of his sexual convictions and the existence of the order.
The order is to last until the 4.4.19

You will note from my previous posts that my wife has a delivery date in October, However she had some problems yesterday (Friday) and she was admitted to the Birth Centre (Hospital) section of the hospital. I stayed with her for about a couple of hours and then came back home and then went back again with some of her stuff for her to use while staying in hospital. However this time I was refused to enter the reception. My wife came escorted with a nurse, took her material from me and went back. I phoned the antenatal wife and was told that due to my past record I would not be allowed to see my wife until she goes into labour. When I pressed for exact reasons, I was told that the head midwife would phone me today (Saturday) and there would be a meeting on Sunday to decide whether I would be allowed to have contact with my baby to be born.
I have been to this antenatal department before several times with my wife. I attend at quite regular interval my hospital for myself; go to other hospitals to visit my family and friends admitted. So how could be safe than to be any children happen to be around but not now.
What is your advice, please?

Also during the meeting I want to be represented by my solicitor? Will the Social Services pay the Solicitor’s fee for the meeting and if the case went to the court. Although we are not on benefits, our account is running in overdrafts as recently we bought a house. We started got refurbishing but out builder ran away with £400 and cannot be found. Also we had over £1000 taken out from Direct Debit for an internet bill, which we never used.

I desprately need advice in these matters. Many Thanks
